Two small boys were charged on summons, with stealing at Redbank, a number of carpenter's tools, the property of Mr. F. Payne. After the evidence of Constable Daly, who interviewed the boys, and Mr. F. Payne, the mother of the boys gave evidence The police stated that there had never been any complaint against either of the boys. The Police Magistrate lectured the boys, and warned them that if they came before the court again they would be severely dealt with, and would be sent away from home. The costs amounted to 23s 4d, and the P. M., stated that if the amount was paid no further penalty would be enforced. The amount was paid3 .

20 September 1900
Mudgee Police Court.
MONDAY, 17th SEPT. (Before Mr. T. H. Wilkinson, P.M., and Mr. H. A. Lowe, J.P.)
AN APPLETREE FLAT CASE.
William Bennett, the well known farmer of Appletree Flat, was summoned for not sending his children to school at Tunabutta.
Mr. G. Davidson, who appeared for the defendant, said that Mr. Bennett was most anxious to send his children to school, but not to this one, as the teacher had a most uncontrollable temper, and was therefore incompetent. The teacher is a Mrs. Cunliffe, and numerous petitions had been sent in to the Department against her conduct. Anyhow, Mr. Bennett was outside the distance from the school as required by the Act.
Constable Daly, who had charge of the case, said he had been instructed not to subpoena witnesses until he knew how the defendants pleaded. If a person pleaded "not guilty" he was then empowered to summon the teacher of the school.
The Police Magistrate said that if the distance from the defendant's house to the school was further than required by the Act that would stop further proceedings.
Mr. Bennett: I have measured the distance myself. It is two miles and thirty chains.
The P.M.: By the nearest road?
Mr. Bennett: By the only road passable. It is shorter to go over by a mountain.
Mr. Davidson: Mr. Bennett is having all his children taught by his wife and daughter, and they are getting on well, and ever so much better than by their late teacher.
William Bennett deposed: Am a farmer, and live at Appletree Flat; used to send my children to the Tunnabutta school, Mrs. Cunliffe being the teacher; found the distance from the school to my place to be two miles 30 chains, which I measured; this is the nearest track, except by going over a mountain; the school children are in dread of the teacher, and are frightened of her; my children are now taught at my own house, and are getting along well; the teacher has no control over her temper; some time ago one of my children came home with marks, showing where she had been beaten over the head.
The Police Magistrate said that no doubt there was no love between the teacher and the defendant for some time. In the public schools there was altogether too much cane used on the children, some of whom got severely beaten because they could not do their lessons. There were several complaints of schools in the district where parents complained of the ill-treatment of their children. The case was dismissed4 .
